Mediation & Alternative Dispute Resolution (ADR)

Mountain Law Firm ADR recognizes there is a need for cost effective resolutions not just on the Western Slope but throughout Colorado as a whole. James F. Fosnaught serves as the third party neutral and has the litigation experience, creative problem solving, and demeanor well-suited for dispute resolution services. His litigation practice of nearly 25 years has and continues to include representing local governments, non-profits, individuals, and private and public companies, from both a plaintiffs and defendants perspective. Having represented thousands of clients, participated in numerous bench and jury trials, conducted private arbitrations, participated in more than 70 Federal court cases in multiple states, and more than 400 Colorado state lawsuits provides James with a broad experience in the types of civil claims prevalent in our mountain communities. James’s practice has been varied, but it has primarily focused on contract, business, construction and real estate disputes.
Mediation and arbitration are effective and efficient vehicles to resolve disputes. Litigation is extremely expensive both financially and emotionally. Mediation can save parties months and sometimes years of emotional turmoil, many thousands of dollars in attorney’s fees and expenses, and it also affords the parties the opportunity to settle upon mutually agreeable terms not always available from a jury or judge’s decision. A good mediator can provide thoughtful, creative, and fair options for resolutions of disputes that a court cannot provide.
At Mountain Law Firm ADR, we have the facilities and technologies to do either in-person or remote access via Zoom mediations. James is also available to travel to your location in Colorado or beyond. If you wish to schedule a mediation, an independent case evaluation, or an arbitration, you may contact Mountain Law Firm ADR at (970) 925-2261 or provide your inquiry by email to ADR@mountainlawfirm.com. We can provide you with dates of availability, current fees, and procedures, run a conflict-of-interest check, and address any other matter of concern.
We look forward to the opportunity to assist you in resolving your dispute.
